A. Contract
A booking is accepted and becomes definite from the date Say Hueque has received the client’s initial deposit. It is at this point that a binding contract between Say Hueque and the Client comes into existence. By submitting deposit and personal information, clients agree to our Terms and Conditions. The contract is between Say Hueque and the Client, being all persons named on the booking form. The person signing the booking form, warrants that he/she has full authority on behalf of all the persons whose names appear thereon, and confirms that all such persons are fully aware of and accept these conditions.
B. Payment
To secure a booking with Say Hueque, the client must deposit 900 USD per person. The balance of all monies due must be paid to Say Hueque no later than 75 days before departure. In case of non- payment of the balance by the due date Say Hueque will treat the booking as canceled by the Client. In the case of bookings made within 75 days of the departure date, full payment of the balance is due immediately.
C. Changes & Cancellation by the Client
Any changes to the original booking must be confirmed by the person signing the booking form. Any costs or charges, which we incur or which are incurred or levied by our suppliers as a result of the amendment, will be charged to the Client. Whilst every reasonable effort will be made to accommodate changes and additional requests, their availability cannot be guaranteed. The Client may cancel the booking at any time provided that the cancellation is communicated to Say Hueque in writing. Cancellation charges will be applied as shown below calculated from the day written notification is received by Say Hueque. In addition to the charges shown below airlines may impose 100% cancellation charges.
In case part of a booking is canceled, the remaining party may have to pay additional charges (e.g. under-occupancy, or single-room supplements).
D. Changes and Cancellation by Say Hueque
While Say Hueque will use its best endeavors to operate all tours as advertised, by entering into this contract the Client accepts that it may prove necessary or advisable to vary or modify a tour itinerary or Period before departure written notification is received Cancellation fee as a percentage of the holiday price

its contents due to prevailing local conditions. Say Hueque reserves the right at any time to cancel or change any of the facilities, services or prices (including flights, accommodation or other arrangements) and to substitute alternative arrangements of comparable monetary value without compensation and accepts no liability for loss of enjoyment as a result of these changes. If a major change is known to us, the Client will be told at the time of the booking. If a major change becomes necessary after booking, Say Hueque will inform the Clients as soon as reasonably possible. When a
major change is made the Client will have the choice of accepting the change of arrangements, purchasing any other available tour or canceling the tour and obtaining a full refund. Provided that the major change is not because of force majeure. Force majeure is war, threat of war, riots, civil strife, industrial dispute, terrorist activities, natural or nuclear disaster, fire or adverse weather conditions, technical or maintenance problems with transport, changes imposed by cancellation or rescheduling of flights by an airline, the alteration of airline or aircraft type, or other similar events beyond the control of Say Hueque. Say Hueque is not liable for any charges in the event of a change beyond their control to the departure time or date of a tour, flight or other form of transport.
E. Passport, Visa and Vaccinations
It is the responsibility of the Client to be in possession of a valid passport, visa permits, inoculations and preventive medicines as may be required for the duration of the tour. Information about these matters or related items is given in good faith but without responsibility on the part of Say Hueque.
F. Illness or disability
Anyone suffering from illness or disability or undergoing treatment for any physical or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment which may be required during the tour. Failure to make such disclosure will constitute a breach of these booking conditions and result in such persons being excluded from the tour in which case all monies paid will be forfeit.
G. Travel Insurance
Say Hueque does not provide such service and prices published at www.sayhueque.com do not include Travel Insurance. However, Say Hueque highly recommend you must be covered by appropriate travel insurance for the complete duration of your holiday. Your insurance should include cover for cancellation charges, medical expenses (including the cost of repatriation and evacuation by
helicopter/air ambulance/other appropriate means in the event of medical need), injury, death and liability to third parties. Should you require emergency medical rescue or evacuation whilst you are on holiday, whether on foot, by helicopter or otherwise, you are responsible for all costs involved. Any costs incurred after your rescue or evacuation for expenses such as hotels, food, transport etc will also be your sole responsibility. It is imperative that all persons traveling have appropriate insurance cover in place before departure which covers all such costs and eventualities. It is your responsibility to ensure that the insurance cover you purchase is suitable for your particular needs. All luggage and personal possessions, including bikes, are at all times at your own risk. We will not be responsible for any loss, damage or accident to any luggage and property, howsoever incurred. We recommend that all items you take with you (including camera equipment, phones, laptops, watches and other forms of technology) are properly covered by insurance .
H. Complaints
If the Client has a complaint about any of the tour arrangements he/she must bring it to the attention of the tour leader or other representative of Say Hueque at the time so that they may use their best endeavors to rectify the situation. It is only if Say Hueque is made aware of any problems that there will be the opportunity to put things right. Failure to complain on the spot will result in the Client’s ability to claim compensation from Say Hueque being extinguished or at least reduced. Should the problem remain unsolved a complaint must be made in writing to Say Hueque within 28 days of the completion of the holiday.
I. Authority during group trip In booking a group holiday with us, you agree to abide by the authority of your tour leader, represented by Say Hueque Patagonia SRL. The decision of the leader as to the conduct, itinerary and objectives of the trip is final. You must at all times comply with the laws, customs, foreign exchange and drug regulations of all countries visited, and you also agree to travel in accordance with the Company’s responsible travel guidelines. If, in the reasonable opinion of the tour leader, your behavior or physical or mental condition is such that it may be detrimental to the safety, welfare and/or wellbeing of the group as a whole, or if the leader considers your general wellbeing will be put at risk by continuing with the holiday, you may be asked to leave the trip.
In this event, our contractual obligations in respect of the remainder of your holiday will come to an end and, save for any return flight or other return travel arrangements , we will have no further responsibility to you for the remainder of your stay. Return flight or other travel arrangements will be subject to the carrier agreeing to your using their services in the circumstances. You will not be entitled to any refund for unused or other services or to payment of any expenses or compensation.
J. Flight Bookings
Say Hueque will use its best endeavors to ensure that all flight prices are correct at the time that they are quoted. Airlines reserve the right to amend or withdraw fares without prior notice. Once a deposit is paid on an airfare, it guarantees that a booking is being held for you, it does not guarantee the fare. The fare can only be guaranteed when the flight booking has been paid for in full and a ticket has been
issued. Flight bookings cannot be transferred. The flight times given by Say Hueque are for general guidance only and are subject to change. Up-to-date flight times will be shown on the tickets. The Client must check the tickets very carefully immediately upon receipt of the latest timings. Say Hueque will endeavor to inform the Client as soon as possible in the event of any flight alteration. Details of airlines are also subject to change. Such alterations do not constitute a significant change to the holiday arrangements and will therefore not be entitled to cancel without paying the normal charges as a result. Say Hueque can not be held responsible for any delay to your flight whether this delay is caused by adverse weather conditions, the action of air traffic controllers, airport authorities or (local) governments, the rescheduling of flight times by the airline, mechanical breakdown, strike, industrial action or any other reason.
K. Our responsibility
Say Hueque accepts responsibility for ensuring that the holiday which the Client books with them is supplied as described in the final version of the travel program the Client will receive upon arrival and the services reach a reasonable standard. Say Hueque acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, it is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the tour, or through natural disasters, social upheavals or other causes.
